1. OVERVIEW AND ACCEPTANCE
This website and the services made available through it are operated by Origin Art Academy (“Company,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our website, digital platforms, content, products, and services (collectively, the “Services”).
By accessing our website or purchasing, enrolling in, or using any Services, you agree to be legally bound by these Terms, our Privacy Policy, and any additional policies or guidelines referenced herein. If you do not agree to these Terms, you may not access or use the Services.
These Terms constitute a legally binding agreement between you and Origin Art Academy.
2. ELIGIBILITY AND AGE REQUIREMENTS
By using the Services, you represent and warrant that:
You are at least the age of majority in your jurisdiction; or
You are using the Services with the consent and supervision of a parent or legal guardian.
We do not knowingly permit individuals under the age of 18 to create accounts or purchase Services without verified parental consent.
3. MODIFICATIONS TO TERMS
We reserve the right, in our sole discretion, to update or modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
4. ACCOUNT REGISTRATION AND RESPONSIBILITIES
To access certain Services, you may be required to create an account. You agree to:
Provide accurate, current, and complete information
Maintain the confidentiality of your login credentials
Accept responsibility for all activity conducted through your account
We reserve the right to suspend or terminate accounts that contain false, misleading, or incomplete information.
5. PRODUCTS, SERVICES, AND DIGITAL CONTENT
All Services provided are digital educational products, including but not limited to online courses, live classes, recordings, downloadable materials, and community access.
You are granted a limited, non-exclusive, non-transferable, revocable license to access the Services for personal, non-commercial use only.
We do not guarantee any specific educational, creative, professional, or financial outcomes.
6. PAYMENT, BILLING, AND TAXES
You agree to provide valid and accurate payment information and authorize us to charge all applicable fees at the time of purchase.
We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or unauthorized transactions.
You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.
7. REFUND POLICY
Refund eligibility varies by course and is subject to the conditions outlined below, except where otherwise required by applicable law.
7.1 Live Courses and Cohort-Based Programs
For live, cohort-based online courses lasting six (6) to eight (8) weeks:
A full refund may be requested up to seven (7) days after the first live class session.
Refund requests submitted after Day 7 and before the end of the second week of the course may be eligible for a fifty percent (50%) refund, minus any non-refundable processing fees.
No refunds will be issued after the second week of the course, regardless of attendance, participation, or completion status.
7.2 Digital Content and Materials
Because digital materials are delivered immediately and cannot be returned, all digital content, including but not limited to recordings, downloadable files, templates, and community access, is non-refundable once accessed.
7.3 Refund Requests
All refund requests must be submitted in writing to [email protected]. Approved refunds will be processed to the original payment method within a reasonable timeframe.
8. EU CONSUMER RIGHTS (EEA & UK USERS)
If you are a consumer located in the European Economic Area (EEA) or the United Kingdom, you have certain statutory rights that cannot be waived.
8.1 Digital Content & Right of Withdrawal
By purchasing digital content and accessing it immediately, you expressly consent to the immediate performance of the Services and acknowledge that you waive your statutory 14-day right of withdrawal once access has begun, as permitted under Article 16(m) of Directive 2011/83/EU.
8.2 Statutory Guarantees
Nothing in these Terms limits or excludes mandatory consumer protections available under applicable EU or UK law, including rights related to conformity of digital content.
9. INTELLECTUAL PROPERTY RIGHTS
All content, materials, trademarks, logos, videos, course materials, and intellectual property associated with the Services are owned by or licensed to Origin Art Academy.
You may not copy, reproduce, distribute, sell, sublicense, share, or exploit any portion of the Services without prior written consent. Unauthorized use may result in termination and legal action.
10. USER FEEDBACK AND SUBMISSIONS
If you submit feedback, ideas, or suggestions (“Feedback”), you grant Origin Art Academy a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute such Feedback without compensation or attribution.
11. STUDENT WORK, RECORDINGS, AND LICENSE GRANTS
11.1 Student Work Ownership
You retain full ownership of any original assignments, exercises, images, videos, or other creative work you submit as part of the Services (“Student Work”). Nothing in these Terms transfers ownership of your Student Work to Origin Art Academy.
11.2 License for Instructional Use
By submitting Student Work, you grant Origin Art Academy a non-exclusive, royalty-free, worldwide license to display, reproduce, and use such Student Work within live sessions, course recordings, private course platforms, and community spaces (including Discord) for instructional and educational purposes.
11.3 License for Marketing and Promotion
By enrolling in a course, you grant Origin Art Academy a non-exclusive, royalty-free, worldwide license to display, reproduce, and share Student Work for marketing, promotional, or informational purposes, including but not limited to website pages, sales pages, social media content, email newsletters, course previews, testimonials, or case studies.
Student Work may be shown with or without attribution. No sensitive personal information will be displayed.
You may opt out of marketing use at any time by contacting [email protected]. We will cease future use where reasonably practicable.
11.4 Live Sessions and Recordings
Certain Services may include live sessions that are recorded. Recordings may include instructor audio and video, instructional content, screen shares, chat messages, and limited student participation such as voice, text, or shared work.
By participating, you grant Origin Art Academy permission to record, reproduce, edit, and reuse such recordings for educational and commercial purposes, including downloadable and evergreen products, consistent with our Privacy Policy.
11.5 Editing and Limitations
When recordings or Student Work are reused:
The primary focus will be on instructor-led instruction
Student identities will not be intentionally featured
Content may be edited, anonymized, muted, blurred, or removed
Student Work will not be sold as standalone assets or licensed to third parties outside of Origin Art Academy’s educational or marketing activities.
11.6 Survival of Licenses
The licenses granted in this section survive termination of your account or withdrawal of consent to the extent permitted by law.
12. PROHIBITED USES
You agree not to:
Use the Services for unlawful or unauthorized purposes
Infringe intellectual property or privacy rights
Reverse engineer or create competing services
Share access credentials or paid materials
Upload malicious code or disrupt platform functionality
Scrape, harvest, or misuse data
We reserve the right to investigate violations and take appropriate action, including suspension or termination.
13. THIRD-PARTY TOOLS AND LINKS
The Services may include links to or integrations with third-party tools. We do not control or endorse these third parties and are not responsible for their content, policies, or practices. Use is at your own risk.
14. DISCLAIMER OF WARRANTIES
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORIGIN ART ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
16. ARBITRATION AND CLASS ACTION WAIVER (U.S. USERS)
PLEASE READ CAREFULLY. THIS AFFECTS YOUR LEGAL RIGHTS.
16.1 Mandatory Arbitration
Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.
16.2 Class Action Waiver
You agree that any arbitration or proceeding shall be conducted on an individual basis only and not as part of a class, collective, or representative action.
16.3 Opt-Out
You may opt out of this arbitration provision within thirty (30) days of first accepting these Terms by emailing written notice to [email protected]. This section does not apply where prohibited by law.
17. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Origin Art Academy and its officers, directors, employees, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the Services or violation of these Terms.
18. TERMINATION
We may suspend or terminate your access to the Services at any time for violation of these Terms or applicable law. Termination does not entitle you to a refund.
19. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
20. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Origin Art Academy and govern all intellectual property rights, licenses, data usage, and dispute resolution related to the Services.
21. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict-of-law principles. EU consumers may additionally rely on mandatory consumer protections in their country of residence.
