By purchasing digital content and accessing it immediately, you expressly consent to the immediate performance of the Services and acknowledge that you waive your statutory 14-day right of withdrawal once access has begun, as permitted under Article 16(m) of Directive 2011/83/EU.

8.2 Statutory Guarantees

Nothing in these Terms limits or excludes mandatory consumer protections available under applicable EU or UK law, including rights related to conformity of digital content.



9. INTELLECTUAL PROPERTY RIGHTS

All content, materials, trademarks, logos, videos, course materials, and intellectual property associated with the Services are owned by or licensed to Origin Art Academy.

10. USER FEEDBACK AND SUBMISSIONS

14. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORIGIN ART ACADEMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.



15. ARBITRATION AND CLASS ACTION WAIVER (U.S. USERS)

15.1 Mandatory Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

You agree that any arbitration or proceeding shall be conducted on an individual basis only, and not as part of a class, collective, or representative action.

You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing written notice to [email protected].

This section does not apply where prohibited by law.



16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Origin Art Academy and its officers, directors, employees, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the Services or violation of these Terms.



17. TERMINATION

We may suspend or terminate your access to the Services at any time for violation of these Terms or applicable law. Termination does not entitle you to a refund.



18. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.



19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Origin Art Academy and supersede all prior agreements or understandings.



20. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict-of-law principles.

EU consumers may additionally rely on mandatory consumer protections in their country of residence.
